Patrick Harvie, a member of Scotland’s parliament, wanted to adjust current Scottish law to ensure that men and women engaging in consensual BDSM weren’t arrested as sex criminals.
However, he dropped a bid to change the law after Justice Secretary Kenny MacAskill and other MSPs said lifting the threat of prosecution could provide a loophole for those charged with domestic abuse and sex crimes.
Then write the law intelligently and realistically. I suspect that it is discomfort with kink and fetish than worry about abused spouse that is at work here.
